Madoff's brother?pleads guilty to fraud charges

UPDATED 12:15 p.m. ET: Peter Madoff, the?brother of convicted scammer Bernie Madoff, pleaded guilty Friday to doctoring records to hide?the?Ponzi scheme orchestrated by his older sibling that swindled thousands of people out of billions of dollars and stunned the world?in?the throes of the financial crisis.

"I am deeply ashamed of my actions," he told a hearing in downtown Manhattan federal court on Friday morning, several hours after he was taken into custody by FBI agents at his lawyer's office in midtown Manhattan.

"I want to apologize to anyone who was harmed and my family. I'm here to take responsibility for my actions," Peter Madof

Peter Madoff, 66,?had been?arrested earlier?Friday at his lawyer's office in?midtown Manhattan and had been expected to enter the guilty plea for which he's expected to get 10 years in prison. He?entered the plea?in the same courthouse where his brother, 74, was convicted and sentenced in March 2009 to 150 years in prison for the largest Ponzi scheme ever.

"Peter Madoff enabled the largest fraud in human history. He will now be jailed well into old age, and he will forfeit virtually every penny he has. We are not yet finished calling to account everyone responsible for the epic fraud of Bernard Madoff and the epic pain of his many victims," said Manhattan U.S. Attorney Preet Bharara in a statement.

Federal prosecutors on Wednesday revealed in a letter that Peter Madoff had been criminally charged with participating in his brother's fraud. He and his brother are the only?Madoff family members to have been arrested and charged in the Ponzi scheme.

The letter, filed in federal court in Manhattan, said Peter Madoff would?plead guilty to charges of conspiracy to commit securities fraud and falsifying records as well as other charges. He agreed not to seek a sentence other than 10 years in prison, the letter said.

Peter Madoff also agreed to forfeit about $143.1 billion, including all real and personal property, the letter said. The amount is symbolic, being more than twice the estimated size of the fraud.

John Wing, a lawyer for Peter Madoff, did not immediately respond to a request for comment.

Peter Madoff was chief compliance officer at Bernard L. Madoff Investment Securities LLC when his brother was arrested on December 11, 2008.

Prosecutors have not said whether criminal cases are also being prepared against Bernard Madoff's son, Andrew, who was co-director of trading, or his niece, Shana, who was a compliance officer at the firm.

In May, Irving Picard, the trustee seeking money for victims of the Ponzi scheme, named members of Madoff's family in an expanded $255.3 million lawsuit, claiming they should have detected Bernard Madoff's Ponzi scheme at the firm that operated "as if it were their family piggy bank."

Besides Madoff's brother Peter, Picard sued Andrew Madoff, who was co-director of trading; the estate of son Mark, co-director of trading who committed suicide in December 2010; and Shana Madoff.

In the lawsuit, Picard described Peter Madoff as a savvy investor who once served as vice-chairman of the board of governors of the Financial Industry Regulatory Authority.

Picard is seeking $90.4 million from Peter, $81.3 million from Mark Madoff's estate, $73.8 million from Andrew and $15.3 million from Shana.

Lawyers for Andrew and Shana Madoff did not immediately return calls seeking comment.

Between 1993 and 2008, Peter Madoff was paid over $36 million in salary and bonuses, Picard said, and the firm funded his lavish lifestyle, including $140,000 for a Ferrari in 1995 and a home on Manhattan's upscale Park Avenue.

Peter Madoff is charged with one count of conspiracy to commit securities fraud and mail fraud as well as making false statements about the firm's compliance program and investment advisory business.

He is also charged with falsifying records.

About a dozen people have now been implicated in criminal wrongdoing related to the Madoff firm.

Five have pleaded not guilty: Annette Bongiorno, Daniel Bonventre, Joann Crupi, Jerome O'Hara and George Perez.

Frank DiPascali, the former chief financial officer often called Bernard Madoff's right-hand man, pleaded guilty in August 2009 and has been praised by prosecutors for his cooperation. He has yet to be sentenced.

Picard has estimated customers of the Madoff firm lost about $20 billion. On Monday, the U.S. Supreme Court let stand a lower court ruling on the trustee's methods for calculating losses. That decision could help Picard repay customers faster.?

A combination of factors, including Earth slowing down a bit from the tidal pull of the moon, and an atomic clock that's a hair too fast, means that periodically timekeepers have to synchronize the official atomic clocks, said Daniel Gambis, head of the Earth Orientation Service in Paris that coordinates leap seconds.

The time it takes the Earth to rotate on its axis ? the definition of a day ? is now about two milliseconds longer than it was 100 years ago, said Geoff Chester, spokesman at the U.S. Naval Observatory, keeper of the official U.S. atomic clocks. That's each day, so it adds up to nearly three-quarters of a second a year.

Timekeepers add that leap second every now and then to keep the sun at its highest at noon, at least during standard time. This is the first leap second since January 2009 and the 25th overall. Gambis said the next one probably won't be needed until 2015 or 2016.

There should be no noticeable affect or inconvenience on computers or any other technology that requires precise timekeeping because they adjust for these leap seconds, Gambis said Friday.

Earlier this year, official timekeepers from across the world discussed whether to eliminate the practice of adding leap seconds. They decided they needed more time to think about the issue and will next debate the issue in 2015.

So for now, Chester said, "you get an extra second, don't waste it."

Treatment of Neuropathic Pain: The Functional Rehabilitative ...

Neuropathic pain is notoriously difficult to treat and often do not respond to conventional analgesics. The pain management is often frustrating for the patient and the health care provider. It is rarely possible to predict the high success rate for any single therapy and often the patient will receive multimodal treatment. Treatment often involves trial and error, titration of medications also limited by side effects, and weighing of risks and benefits of therapy. The functional approach to rehabilitation is often highlighted by the return to school and palliative care are the goals that often the pain is persistent. Most pharmacological treatments is based on extrapolation of treatment for adults with opioids, antidepressants, anticonvulsants, and local anesthetic-like drugs demonstrating varying degrees of effectiveness. Most drugs used are not traditional analgesics, and data on the safety and pharmacokinetics of the use of these drugs in children came from clinical trials for the treatment of depression, epilepsy, and enuresis. Generally, a slower titration of these drugs is recommended to minimize side effects and to detect adverse effects. There is often a compromise between moderate analgesia and some side effects.

Seeking elusive 'alpha,' investors scour the globe

(AP) ? You can leap off a mountainside in extreme skiing, kick and claw to near death in extreme fighting and twist yourself into a pretzel in extreme yoga. Why not turn investing into an adventure sport?

Professional money managers are scouring the world for oddball assets, desperate to find anything that moves to its own beat rather than rising and falling with everything else in the financial markets.

They are putting money into racehorses, stakes in lawsuits, old coins, even the copyrights to old pop songs. One fund manager bought stock in a beer company called Bralirwa in Rwanda, where tribal rivalry led to a genocide that left 800,000 people dead in 1994.

"Rwanda triggers a lot of bad memories, so people don't even think of investing there, but there's huge opportunity," says Lawrence Speidell of Frontier Market Select Fund, which also owns stock in an Iraqi soft drink bottler and a Palestinian telephone company.

Bralirwa stock has risen 150 percent since Speidell bought it early last year. But the real appeal is that it did so in a steady, calm way, disregarding events that have made the rest of the world's stock markets bumpy and frightening, like the Japanese tsunami and European debt troubles.

And Bralirwa keeps bucking the headlines. Last month, while stocks in the U.S., Europe, Asia and Latin America fell because of fear that Greece would leave the euro and Spain needed a bailout, Bralirwa rose 6.5 percent. Even Apple, a stock known to shrug off scary headlines itself, got swept along in the downdraft.

In trading jargon, the Rwandan company and some of Speidell's other exotic holdings are "uncorrelated." They have a tendency to move to their own rhythm, a sort of Holy Grail in investing.

Discover enough of these assets and a money manager might claim to have achieved "alpha," an ability to beat the Standard & Poor's 500 or other indexes without taking on more risk.

Convincing investors of the claim is another matter. For years, ordinary investors trusted their fund managers, paying them tens of billions of dollars in annual fees. But they've grown skeptical. They've pulled more than $400 billion from U.S. stock mutual funds since 2008.

Not only did the managers fail to protect against losses in the financial crisis that year, but too much of what they've bought since seems to ride up and down with the stock indexes.

Not lawsuits, though. In exchange for a cut of the winnings, funds have sprung up to help pay for suits brought by wives in divorce court, by 9/11 cleanup crews against New York City for health problems and, in one case, by two foreign businessmen in a two-decade dispute with the republic of Georgia for reneging on a gas-pipeline deal.

"It gives David a chance against Goliath," says Sean Coffey, co-founder of BlackRobe Capital Partners, a lawsuit-financing company started last year. And, he adds, "It doesn't matter what happens in Greece."

It can prove just as risky. In lawsuit investing, a fund gets something akin to a share of one side of the dispute. If that side loses in court, the investors are out their money. If that side wins, the investors get their money back with profit.

Sometimes big profit. In one celebrated case, Burford Group, a lawsuit lender, contributed $4 million in November 2010 to help Indians from the Ecuadorean rain forest pay for a pollution suit against Chevron.

A few months later, an Ecuadorean judge ordered the oil company to pay $18 billion. Chevron appealed and lost, but is suing lawyers and consultants from the other side for fraud. Burford appeared in position to collect big profits ? or rather could have if it hadn't traded much of its stake in the outcome to an undisclosed firm.

Yes, you can trade lawsuit stakes like stocks.

For years, professional investors in pursuit of alpha poured money into developing countries, stocks of small companies, commodities and funds buying pricey art or wine. Success has been rare, which has only driven the pros to venture deeper, farther.

Once upon a time, putting money into Brazilian, Russian, Indian and Chinese stocks was considered the kind of extreme investing that could protect investors. Even if U.S. stocks fell, the so-called BRIC markets would rise as the middle classes of these countries grew.

Or so the thinking went. Then came the U.S. financial crisis, and investors discovered foreign markets had too many trade and financial ties with the U.S. to offer much help. In fact, they can make things worse. U.S. stocks fell 37 percent in 2008, but each of the BRICs fell more.

Since then, those markets have broken the link with the U.S. only occasionally, though not always in a good way. Stocks in each of these emerging economies fell 20 percent or more last year while the S&P 500 gained 2.1 percent, if you count dividends.

Another popular diversification move, buying commodities, used to work. When stock prices were falling, it was often because commodity prices were rising. Buying commodities at the right time handed investors big profits.

But in a United Nations report in March, two economists tracking commodity prices over 16 years found they increasingly move up and down with U.S. stocks, instead of in opposite directions as in the past. In May, the S&P 500 fell 6 percent and commodities lost 9 percent.

For the lockstep moves, blame the so-called wisdom of the crowd. No sooner does an investor discover a far-off place or obscure asset moving to its own rhythm than everyone else seems to show up with fistfuls of dollars.

The U.N. report on commodities, for instance, notes that investors, including many betting with 401(k) plans, had $450 billion in commodity funds last year, up from less than $10 billion in 2000. That makes prices more likely to gyrate up and down with greed and fear surging across the globe in reaction to news, the same as stocks.

If you're rich enough, you can always turn to the folks who claim to have more alpha than anyone else, the managers of hedge funds. The appeal of these exclusive investing vehicles is that they can bet markets will fall as well as rise, and often use borrowed money to do so, which provides leverage. For access to their alleged prowess, managers charge you $2 for every $100 invested each year, and take a fifth of annual profits, if there are any.

There weren't many last year. The average hedge fund lost more than 5 percent, according to fund tracker Hedge Fund Research. Curiously, the dismal showing hasn't slowed demand for the funds. They now number nearly 7,600, back almost to their peak at the start of 2008.

During the meltdown that year, one scholar of investing, a former editor of the Financial Analysts Journal, dared to state the obvious in a short article with a blockbuster title: "The Uncorrelated Return Myth."

It's not clear things have improved much. Exotic fare like rare coins and fine wine funds have mostly risen in recent years, but so have stocks, making you wonder whether they'll fall together, too.

Avarae Global, a rare-coin fund that lost half its value in 2008, is up 27.7 percent in two years, a near carbon copy of the 26.7 percent rise for the S&P 500. The Vintage Wine Fund appears to be moving on its own more, but that isn't necessarily good. It dropped 22 percent last year.

Better to stick with the song "Guantanamera," which has managed to buck even the worst of times.

"2008 was actually our best year," says Brett Hellerman, CEO of Wood Creek Capital Management, a hedge fund that owns the copyright to 30,000 songs, including the Cuban standard, and claims double-digit annual returns. When someone downloads "Guantanamera," Wood Creek pockets as much as 9.1 cents.

Not adventurous enough? You can always bet on Madoff money. Some hedge funds are paying victims of the Ponzi scheme pennies on the dollar for their official claims on a hunch they will bring big profits later when the bankruptcy court divvies up recovered money. Or you can play the ponies. A firm registered in Malta is trying to drum up interest in a new fund, called Resco Thoroughbred, that would race them for prize money and sell them.

Those looking for extreme investing on the cheap may want to check out exchange-traded funds, which typically charge half what mutual funds do and, unlike them, can be traded all day like stocks.

ETFs are exploding in number and variety. Bullish on China, but only on the small companies? Think stocks in Kazakhstan are about to soar? Or the Polish currency, the zloty? There are ETFs for that.

Or you can skip it all and bet on the only thing that's near-certain: That Wall Street will continue to sell the promise of high returns divorced from the U.S. stock market, and people will continue to pay for the effort.

Since its October low, the PowerShares Dynamic Financial Sector ETF, which holds stocks of U.S. banks and investment firms, is up 25 percent.

Do you ever tire of hearing that a Hollywood remake is in the pipeline, when the ink has hardly dried on the original script? Like "The Girl With The Dragon Tattoo", "Cell 211" and "Let The Right One In" before it, this is another that has had the green light for an English language version. It's easy to see why there would be interest in this as it's an exceptionally good thriller. I just don't see why it's necessary to have it redone. Roger Brown (Aksel Hennie) is a high-flying businessman who works as a headhunter. He scouts potential applicants for executive jobs. While interviewing them, he learns very useful information that leads him to his second source of income: a sideline in executing valuable art robberies. His extravagant and expensive lifestyle can't be funded by his headhunting job alone. One particular interviewee is Clas Greve (Nicolaj Coster-Waldau). He has all the credentials for a post that Brown needs to fill but he also has just inherited a piece of art that will cure all of Brown's financial woes - if he can just get his hands on it. As it turns out though, this art theft is not as simple as his previous ones and Greve is not as buttoned up as he makes out. As this film opens we are introduced to unlikely leading actor Aksel Hennie who has an appearance that resembles the love child of Christopher Walken and Steve Buscemi. He's not your average leading man and his character is not that appealing either. He's a self-centred weasel of a man that seems to lack any morals but you know that things are, not entirely, going to go to plan for this scheming, double-crossing thief and that's exactly what captures your attention and provides the hook in this adaptation of Norwegian writer Jo Nesbo's novel. Director Morten Tyldum is wise enough to play his cards when he needs them and wrings out the suspense, masterfully, at every turn. He mounts the tension slowly before staging one gripping scene after another. The unpredictability of the spiralling plot delivers genuine excitement, helped immeasurably by natural characters and performers. Hennie in particular, is absolutely brilliant and will no doubt become a household name after this (apparently he already is, in his native Norway). Kudos to screenwriters Lars Gudmstead and Ulf Ryberg. It's their tight, deliberately paced and unpredictable script that keeps you guessing and shows a good level of intelligence. Admittedly, I haven't read the novel but if I were author Jo Nesbo, I'd be very proud of the job that has been done here. When the headhunter becomes the headhunted, this film grips like a vice and refuses to let go. I've seen quite a few film's from Scandinavia over recent years and have been very impressed with the high standard they are delivering. This is no exception and a thriller that will definitely compete with the best of the year.

Pope convenes cardinals to discuss leak scandal

(AP) ? Pope Benedict XVI convened a special meeting of cardinals Saturday for advice on how to deal with the Vatican's leaked documents scandal ? another sign of the damage the leaks have done to trust in the Holy See's governance.

Benedict was already scheduled to attend a regular meeting of the heads of Vatican offices Saturday morning. The Vatican press office said he added a second meeting later in the day with other cardinals in a bid to try to "restore a climate of serenity and trust" in the church.

The Vatican said over the coming days he will meet with still more cardinals gathering in Rome for a church feast day on Friday to "continue the dialogue with the people who share the responsibility of the church's governance with him."

The Vatican has been scrambling to contain the damage after the leak of hundreds of Vatican documents exposed corruption, political infighting and power struggles at the highest level of the Catholic Church. The pope's butler, Paolo Gabriele, is under arrest at the Vatican, accused of aggravated theft after the pope's own documents were found in his Vatican City apartment.

One Holy See investigation into the links is a criminal one headed by Vatican gendarmes; there is also an internal probe led by a commission of three cardinals tasked with getting to the bottom of the scandal.

Last weekend Benedict met with the cardinal's commission to learn details of some of the two dozen people they have questioned.

The meetings Saturday were another indication of the seriousness with which he has taken the scandal and the damage it has done to the trust that is supposed to form the basis of the Vatican's governance.

In its statement, the Vatican said the regularly scheduled meeting with department heads aimed at coordinating the Vatican's work was "today particularly important and urgent to show efficient witness to the union of spirit that animates the Curia."

The second meeting Saturday includes Vatican cardinals, and the archbishops of Sydney and the retired vicar of Rome ? two longtime papal advisers.

Benedict also moved to beef up a panel of cardinals tasked with scrutinizing the "organizational and economic problems of the Holy See," the Vatican said. He appointed to the panel three cardinals: Polycarp Pengo, an archbishop from Tanzania, in Africa; and two Asians, Telesphore Toppo, from India, and John Tong Hong, the Hong Kong prelate who was elevated to the rank of cardinal earlier this year by the pontiff.

All three are involved with the Holy See office that bankrolls missionary work abroad. Two years ago, Italian prosecutors began probing real estate transactions and other dealings of Naples' cardinal, an Italian prelate who formerly headed that office. The Italian authorities have been looking into an alleged web of kickbacks and favors, including purported sexual ones, involving businessmen, church hierarchy and public officials.

Toppo also serves on a cardinals' watchdog committee for the activities of the Vatican bank.

Fat - A food-energy source. Fat has received a bad reputation in the public's eyes for many years. There are good fats and there are bad fats. Oxidized or artificially produced fat such as; polyunsaturated vegetable oils margarine, and shortening(Crisco)? are bad and any amount and all natural fats are good.? Fat slows down the movement of food in the digestive system allowing food more time to be digested and more nutrients especially minerals are absorbed.? Low-fat diets prevent the complete digestion of food promoting mineral deficiencies, such as absorption of Calcium to prevent osteoporosis.?

Fat as an energy food, gives twice as much energy as an equal weight of the other energy foods - protein and carbohydrates. There are three kinds of fat:? saturated, monounsaturated, and polyunsaturated. They are differentiated by their molecular structure.

Three types of Fat:

Saturate fat ? Is a vital nutrient. It is not a poison. It is an important source of energy, it aids in the digestion process, helps the heart and other vital organs, it helps the body maintain its health.? In fact, if the body does not get saturated fat and monounsaturated fat it will make it on its own but not enough for optimal health.

This fat?s bad reputation started in the 1960s, when Dr. Ancel Keys, PhD (1904-2004) using what he called the Mediterranean diet suggested eating too much fat was unhealthy (1953).? He is known as the father of the low-fat diet.? He was with the university of Minnesota physiologist and nutritionist.?? During WWII he came up with ready-to-eat provisions called Field Rations, Type K which eventually came to be known as K Rations. ?

Dr. Keys later work on eating fat and Heart disease made a great impact on the American diet. He concluded that fat elevated cholesterol causing for no known reason a buildup of plague in the arteries walls.? Known as the Cholesterol hypothesis (Diet-Health Hypothesis, and Lipid Hypothesis).

What Dr. Keys failed to study and ignore, is our previous history, our ancestors eating fat, and their? miracle survival of thousands of years before that date.? Animal fats (Lard), beef tallow,? butter, cheese, chicken fat, coconut and palm oil, eggs, ghee (clarified butter), milk, mutton tallow, Nutmeg oil, Peanut Oil, Sour cream, and Vinegar were the common crucial fats used throughout the history of mankind and maintaining healthy cells, healthy organs, and a healthy body.

Note the Low-Fat diet is not the Atikins Low Carbohydrate Diet.? Dr. Atkins was the first Dr. that stood up against the low-fat diet and established the low-carb Atkins Diet and used the? Glycemic index. That diet and other things will be in another post right now let?s continue with a look at fats.

Polyunsaturated fat - is a fatty acid mostly found in plants, it is four or more hydrogen atoms short of saturation. Polyunsaturated fats are the absolute WORST oils to use when cooking because these omega-6 rich oils are highly susceptible to heat damage . When these fats are exposed to heat, light or oxygen they readily oxidize (to your car that means rust) and form free radicals. Our diet needs polyunsaturated fat, our bodies cannot produce this fat so they are essential that we eat them daily.? We must have some in our diet but too much can be detrimental.? Consumption exceeding 10% Omega-6 oils of total calories can lead to blood disorders, cancer, liver damage, and vitamin deficiencies.

When polyunsaturated fats or oils are heated they become known as 4-hydroxy-trans-2-nominal (4-HNE).

Polyunsaturated Fatty Acids - This category includes common vegetable oils (polyunsaturated oils) such as: Canola, Chia Seed, Cod Liver, Corn, Cottenseed, Fish Oils, Flaxseed, Hemp Seed, Herring, Lecithin,? Linseed, Menhaden (Fish Oil), Safflower, Salmon Oil, Sardine Oil, Sesame seed, Soybean, Sunflower, Vegetable Oil, and Wheat germ. Polyunsaturated fat consists of both Omega-3 and Omega-6.?

Monounsaturated fat - is two hydrogen atoms short of being a saturated fat. Olive oil is mostly Monounsaturated then ? saturated and polyunsaturated.

Monounsaturated Fatty Acids - Almond, Avocados, Butterfat, Grape Seed, Olive, Peanut, Pumpkin, Rapseed (canola) and, Sesame. Good source for fat but become toxic if heated.? Heating causes the oil to become oxidized

Olive Oil Good for Health but Not for Cooking

?Researchers concluded that olive oil is a major contributing factor to the health benefits of the Mediterranean diet. While olive oil can and should be a healthy part of your diet, what most people do not appreciate is that olive oil should not be used to cook with. It should be used cold or applied to a dish after it has been cooked.? Olive oil is primarily a monounsaturated fat which when heated can easily break-down and become perishable with oxidative (when your car oxidates it rusts) damage and then forms free-radicals (which cause disease). As it turns out, extra-virgin olive oil contains chlorophyll that accelerated decomposition and makes the oil go rancid rather quickly. So if you plan on using a fat to cook with, your clear choice is coconut oil or butter. Coconut oil is rich in lauric acid which is a proven antiviral and immune system builder.

So in evaluating plant oils for cooking, it should be clear that oils that contain a high percentage of saturated fatty acids are more stable than those that contain a high percentage of polyunsaturated fatty acids. When exposed to heat and light during processing, storage, and use, oils that contain a high percentage of polyunsaturated fatty acids tend to contain more free radicals than oils that contain mainly saturated and/or monounsaturated fatty acids.

I have found that I can add olive oil after I have cooked the food.? I also found that if I mix olive oil with coconut oil, coconut oil stays liquid.? As long as you don?t heat the olive oil it is very good for you.
